PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE FIELDPROVE APPLICATION OR ANY RELATED SERVICES. BY CREATING AN ACCOUNT, ACCESSING, OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS.
These Terms and Conditions (the "Terms") form a legally binding agreement between you ("you," "User," "Technician," "Supervisor," or "Subscriber") and FieldProve Diagnostics LLC, a limited liability company organized under the laws of the State of Georgia, United States ("FieldProve," "we," "us," or "our"), governing your access to and use of the FieldProve mobile application, supervisor application, web platform, and any related software, content, features, or services (collectively, the "Service").
If you do not agree to these Terms, do not install, access, or use the Service.
You must be at least eighteen (18) years of age and capable of forming a legally binding contract to use the Service. By creating an Account, you represent and warrant that you meet these requirements.
The Service is intended for use by HVAC professionals, trainees, and related field service technicians in a commercial or educational context. You represent that you possess, or are working toward, the training and credentials required to perform the diagnostic work you use the Service to support.
You agree to provide accurate, current, and complete information during registration and to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account.
Supervisor Tier accounts may invite Technicians to join a team under a shared billing relationship. The account owner is responsible for the conduct of invited Users on the team and for ensuring those Users agree to these Terms.
FieldProve is a software-based diagnostic assistance tool that uses artificial intelligence to help HVAC technicians analyze equipment symptoms, photographs, and readings. The Service accepts text descriptions, images, and related input and returns suggested causes, next steps, and diagnostic guidance.
THE SERVICE IS A PROFESSIONAL TOOL INTENDED TO ASSIST, NOT REPLACE, THE INDEPENDENT JUDGMENT OF A QUALIFIED HVAC TECHNICIAN. AI Diagnostic Output is informational and probabilistic. It does not constitute certified engineering advice, a warranty of mechanical condition, a safety certification, or a substitute for required code inspections, manufacturer service procedures, or the judgment of a licensed professional.
You are solely responsible for any decision to repair, replace, energize, de-energize, modify, or service any equipment. You agree to independently verify any AI Diagnostic Output against manufacturer specifications, applicable codes, direct measurement, and your own professional judgment before taking action.
We strive to keep the Service available but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, third-party outages (including cloud infrastructure, AI providers, payment processors, or app store platforms), or causes beyond our reasonable control.
We may modify, suspend, add, or discontinue any feature of the Service at any time. Where a change materially reduces the functionality of a paid Subscription, we will make a reasonable effort to notify affected Subscribers.
The Free Tier provides limited daily diagnostics. Usage limits and included features may change at our discretion.
The Premium Tier is a paid individual subscription offering unlimited diagnostics and session history. Current pricing and billing intervals are displayed in the Service at the time of purchase.
The Supervisor Tier is a paid team subscription combining a base account fee with per-Technician seat pricing. The account owner is responsible for all fees incurred by seats added to the account. Seat counts, features, and pricing are disclosed in the Service at the time of purchase.
Paid Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected) and automatically renew until canceled. By subscribing, you authorize us and our payment processors (including, where applicable, Stripe, Google Play, or Apple) to charge your selected payment method on each renewal date at the then-current rate.
We may change Subscription prices. We will provide reasonable advance notice of any price change affecting an existing Subscription, and the new price will take effect at the next renewal following the notice period.
You may cancel a paid Subscription at any time through the Service, your app store account, or by contacting us. Cancellation takes effect at the end of the current billing period. Access to paid features continues until that date.
Except where required by applicable law, all payments are non-refundable. Purchases made through Google Play or the Apple App Store are subject to those platforms' refund policies, and refund requests must typically be directed to the platform.
Prices do not include taxes. You are responsible for any applicable sales, use, value-added, or similar taxes arising from your use of the Service.
You retain ownership of Content you submit to the Service. You represent and warrant that you have all rights necessary to submit that Content, including any photos, notes, customer statements, or identifying information.
You grant FieldProve a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display your Content solely to operate, provide, secure, and improve the Service, including by generating AI Diagnostic Output for you and, where applicable, your Supervisor or team.
We may use de-identified and aggregated Content to improve the Service, train or evaluate diagnostic models, and develop new features. We will not sell your personally identifiable Content or customer-identifying information to third parties.
You are solely responsible for obtaining any consent, authorization, or notice required by law or by your customer before capturing photos of premises, equipment, or documents, or before uploading customer names, addresses, or other identifying information to the Service. You agree not to upload payment card data, government identification numbers, or protected health information.
Where you use the submit-to-supervisor feature, you acknowledge that your notes, photos, and the related diagnostic session will be visible to the Supervisor and account owner associated with your team. You are responsible for the accuracy and professionalism of anything you submit.
You agree not to:
The Service, including its software, user interface, diagnostic prompt systems, models, documentation, trademarks, logos, and all related intellectual property, is owned by FieldProve Diagnostics LLC or its licensors and is protected by United States and international copyright, trademark, and other laws. Portions of the Service are registered with the United States Copyright Office.
Subject to your compliance with these Terms and payment of any applicable fees, FieldProve grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose during the term of your Account.
If you submit ideas, suggestions, or feedback about the Service, you grant FieldProve a perpetual, irrevocable, royalty-free license to use that feedback without obligation to you.
The Service incorporates artificial intelligence and machine learning. AI Diagnostic Output is generated probabilistically and may be incomplete, inaccurate, outdated, or inapplicable to your specific situation. Artificial intelligence systems can produce plausible-sounding but incorrect results, sometimes called "hallucinations."
YOU ACKNOWLEDGE AND AGREE THAT: (A) AI DIAGNOSTIC OUTPUT IS PROVIDED FOR INFORMATIONAL AND ADVISORY PURPOSES ONLY; (B) YOU MUST INDEPENDENTLY VERIFY AI DIAGNOSTIC OUTPUT BEFORE ACTING ON IT; AND (C) FIELDPROVE IS NOT RESPONSIBLE FOR ACTIONS TAKEN OR NOT TAKEN BASED ON AI DIAGNOSTIC OUTPUT.
Wiring diagrams — no manufacturer-specific representation. Wiring diagrams shown in the Service represent conventional industry baselines for the system class displayed. They are not a substitute for the wiring documentation provided by the equipment manufacturer for any specific make or model. You remain solely responsible for consulting and following the manufacturer's installation and service documentation for the specific equipment you are working on. FieldProve makes no representation that any wiring diagram in the Service matches the wiring requirements of any specific manufacturer's equipment, including but not limited to Carrier, Trane, Goodman, Lennox, Rheem, York, Bryant, American Standard, or any other manufacturer.
Wiring diagrams — diagnostic use only, not design. Wiring diagrams in the Service are intended to assist in understanding and verifying existing HVAC installations. The Service is not a design tool for new installations and does not produce permit-ready, code-compliant, or engineering-grade documentation. You are solely responsible for designing any new installation in accordance with applicable building codes, electrical codes, manufacturer specifications, and local jurisdictional requirements.
Wiring diagrams — point-in-time data, not real-time monitoring. Any voltage readings, terminal status indicators, or other measured values shown in a FieldProve wiring diagram represent point-in-time information manually entered by you at the time of the diagnostic session. The Service does not connect to any live measurement hardware, does not monitor HVAC system state in real time, and does not provide ongoing observation of installed equipment. You are solely responsible for re-verifying any voltage or status reading before relying on it for any subsequent action.
HVAC work can involve high voltage, pressurized refrigerants, combustion, sharp edges, and other hazards. You agree that you will not rely on the Service in lieu of proper training, personal protective equipment, lockout/tagout procedures, manufacturer service documentation, or applicable codes and standards. If the Service suggests a diagnostic step that conflicts with manufacturer instructions, code, or safe practice, the manufacturer and code requirements govern.
Wiring diagrams — audience and assumed knowledge. The wiring diagrams shown in the Service are intended for use by trained HVAC technicians familiar with low-voltage thermostat wiring conventions, including standard terminal designations (R, C, Y, Y2, G, W, W2, O, B, E, L) and the operational meaning of each. The Service is not a training tool for homeowners, apprentices working without supervision, or any user without prior HVAC training appropriate to the work being performed. You are solely responsible for confirming you possess the training, licensure, and experience required to interpret and act on any wiring information provided by the Service.
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our processing of personal information as described in the Privacy Policy.
The Service integrates with or relies on third-party services, including cloud hosting providers, AI model providers, payment processors, and app store platforms. Your use of those services may be subject to their own terms and privacy policies. FieldProve is not responsible for the acts or omissions of third-party providers.
The Service does not currently display advertising. If advertising is introduced in the future, we will update these Terms and our Privacy Policy accordingly.
You may stop using the Service at any time and close your Account from within the application.
We may suspend or terminate your Account or access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, created risk or legal exposure for FieldProve, or engaged in conduct harmful to other Users.
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDPROVE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION. WITHOUT LIMITING THE FOREGOING, FIELDPROVE DOES NOT WARRANT THAT AI DIAGNOSTIC OUTPUT WILL BE ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR ANY PARTICULAR SITUATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDPROVE DIAGNOSTICS LLC, ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOST GOODWILL, EQUIPMENT DAMAGE, PROPERTY DAMAGE, PERSONAL INJURY CLAIMS BROUGHT BY THIRD PARTIES, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF FIELDPROVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
FIELDPROVE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FIELDPROVE FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100 USD).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. In such jurisdictions, FieldProve's liability is limited to the greatest extent permitted by law.
You agree to defend, indemnify, and hold harmless FieldProve Diagnostics LLC and its officers, employees, and contractors from and against any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your Content; (c) your violation of these Terms; (d) your violation of any law or the rights of a third party, including a customer, employer, or another User; or (e) any work performed, not performed, or performed incorrectly on equipment in connection with your use of the Service.
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at the address below. We will attempt to resolve the dispute informally within sixty (60) days.
Except for claims that may be brought in small claims court and claims for injunctive relief relating to intellectual property, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by a recognized arbitration provider under its then-current rules. The arbitration will be held in Atlanta, Georgia, or via remote proceedings where available.
YOU AND FIELDPROVE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and provide notice within the Service or by email. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those Terms.
You represent that you are not located in, and are not a national or resident of, any country subject to U.S. government embargo, and that you are not on any U.S. government list of restricted parties. You agree to comply with all applicable export control and sanctions laws.
If you obtained the Service through the Apple App Store or Google Play, additional terms imposed by those platforms apply. You acknowledge that these Terms are between you and FieldProve, not Apple or Google, and that the applicable platform is not responsible for the Service or any claims relating to it. In the event of a conflict between these Terms and the app store's terms with respect to distribution, the app store's terms govern to the extent required.
These Terms, together with the Privacy Policy and any order form or subscription terms presented at purchase, constitute the entire agreement between you and FieldProve regarding the Service.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any provision is not a waiver of our right to do so later.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets.
Neither party is liable for failure to perform caused by events beyond its reasonable control, including natural disasters, power failures, internet outages, labor disputes, acts of war or terrorism, or acts of government.
